Please read these terms carefully before purchasing or using Mindsutra products and online payment services. Use of the shopping service is treated as acceptance of the published terms.
Terms of Sale
Mindsutra.com uses secure credit-card verification and a secure encrypted payment-gateway link. Online fund transfer through a bank account may also be used.
User Agreement
Using the shopping service means the user accepts these terms. Product information is an invitation to offer, while an order is the user’s offer and may be accepted or rejected by Mindsutra.
- The user must be at least 18 years old or have the consent of a parent or legal guardian.
- These terms supersede previous representations, understandings or agreements.
- Prices are stated in the applicable currency shown on the website.
- Prices and product availability may change without prior notice.
- Credit-card transactions must be made using the user’s own card; Mindsutra is not liable for credit-card fraud.
- External links are outside Mindsutra’s control and are provided for convenience, not necessarily as endorsements.
- Software sold by Mindsutra is for single use on a single machine unless a product explicitly states otherwise.
- Where software requires a registration or initialization key, the charge is on a per-key basis and the key is issued once under the published terms.
- Mindsutra may add, delete or modify site content and services, and may terminate or charge for services in the future.
- The user must use the services only for lawful purposes.
- The user must provide authentic and true information; false information may lead to rejection or debarment.
- Mindsutra disclaims responsibility for loss of revenue, data, delays, non-delivery, interruption or damage arising from service failure, errors or omissions as described in the published terms.
- Copyright and intellectual-property rights in text, photographs, audio, video, graphics, trademarks and logos are protected under applicable Indian law.
- The agreement is governed by Indian law and the courts at Delhi have exclusive jurisdiction.
Software Validity
- Software products are valid for five years from the date of first registration.
- If no updated version is released after five years, the software may continue on the Windows version current at the time of purchase.
- If an updated version becomes available, the user may upgrade by paying the difference between the original and updated MRP; validity is then renewed for another five years from the upgrade date.
- Renewal will be subject to successful payment confirmation and the company’s applicable renewal policy.
Mobile App Validity
- Mobile app products are valid for a period of three years from the date of first registration or activation.
- After the expiry of the three-year validity period, the license may be renewed by paying 50% of the app’s applicable MRP at the time of renewal.
- Renewal will be subject to successful payment confirmation and the company’s applicable renewal policy.
A. General Terms for Online Payments
- After accepting the terms, a user may register and use the services through the methods specified by Mindsutra.
- Mindsutra’s rights and obligations remain subject to Indian law and lawful requests from government, regulatory or law-enforcement agencies.
- If any provision is invalid or unenforceable, it is replaced by a valid provision closest to its intent while the remaining terms continue.
- These terms constitute the entire agreement and supersede earlier electronic, oral or written communications and proposals.
- Printed versions of electronic terms or notices may be admissible in judicial or administrative proceedings.
- Business records maintained by Mindsutra or payment providers regarding transactions are treated as evidence of transaction details.
- Refund and cancellation are governed by the separately published Cancellation and Refund Policy.
- Chargeback claims must be made directly to Mindsutra; refunds, if approved, are processed by the method Mindsutra considers appropriate.
- Fraudulent or duplicate transactions should be reported directly to Mindsutra and handled under its policies.
- If a server slowdown, failure or timeout occurs, the user should first check whether the bank account was debited before attempting a second payment. If debited, do not pay twice and contact Mindsutra; if not debited, a fresh transaction may be initiated.
B. Limitation of Liability
- The payment service is offered as a convenience and the user remains responsible for their conduct.
- Mindsutra and payment providers are not liable for inaccuracies, errors, delays, omissions, transmission failures, interruptions or resulting loss as described in the published terms.
- No liability is assumed for delay, failure, corruption of data or interruption in payment-gateway operation.
- The user agrees to indemnify the payment providers and Mindsutra, including their officers, directors, agents and employees, against claims connected with use of the services.
- Mindsutra may terminate the right to use the service without prior notice when required under these conditions.
C. Miscellaneous Conditions
- A waiver of one right does not automatically waive other rights.
- Personal data transmitted online may be susceptible to misuse, hacking, theft or fraud outside the control of Mindsutra or payment providers.
- Reasonable care is taken, but the services cannot be guaranteed against theft or unauthorized use of data over the Internet.
- Mindsutra, payment providers and affiliates are not liable for performance failure, errors, defects, delays, viruses, communication failure, theft, destruction or unauthorized access as stated in the published terms.
- User IDs and passwords must be kept secure and confidential; users are responsible for transactions made under their credentials.
- Mindsutra will not request a password through an unsolicited call or email. Users should sign out and close the browser after transactions, especially on shared or public computers.
D. Debit/Credit Card and Bank Account Details
- Card and bank details must be correct, valid and lawfully owned or authorized for use.
- The user confirms lawful entitlement to use the selected card or bank account, accuracy of details, authorization of the debit and availability of sufficient funds or credit.
E. Personal Information
- Where required or permitted by law, Mindsutra or payment providers may collect, use or disclose information for security, investigation, law enforcement or legal compliance.
- Email communication from the user is treated as a release of the information contained in that communication and permission to respond by email.
- Previously collected information may continue to be used in accordance with the privacy policy and applicable consent.
- Personal information is managed according to the laws in force.
F. Payment Gateway Disclaimer
The payment service facilitates online software payments. Mindsutra and the payment provider make no representation about gateway operation beyond what is stated on the website. By using the service, the user accepts that online payment use is at the user’s own risk and responsibility.
